Beijing Says Security Token Offerings are Illegal\"><\/p>\n<p><img width=\"760\" height=\"400\" data-cfsrc=\"https:\/\/248qms3nhmvl15d4ne1i4pxl-wpengine.netdna-ssl.com\/wp-content\/uploads\/2018\/08\/china-communist-party-guard-blockchain-cryptocurrency-760x400.jpg\" class=\"attachment-large-thumb size-large-thumb wp-post-image\" alt=\"china communist party blockchain sto crypto\"><noscript><img loading=\"lazy\" width=\"760\" height=\"400\" src=\"https:\/\/248qms3nhmvl15d4ne1i4pxl-wpengine.netdna-ssl.com\/wp-content\/uploads\/2018\/08\/china-communist-party-guard-blockchain-cryptocurrency-760x400.jpg\" class=\"attachment-large-thumb size-large-thumb wp-post-image\" alt=\"china communist party blockchain sto crypto\"><\/noscript> <\/a><\/p>\n<\/div>\n<p>Beijing\u2019s Municipal Bureau of Finance chief, Huo Xuewen, has advised projects considering a security token offering as a means of fundraising, stating that <a href=\"https:\/\/www.ccn.com\/op-ed-a-beginners-guide-to-the-economics-behind-security-token-offerings\/\">security token offering<\/a> (STO) fundraising is currently illegal in Beijing.<\/p>\n<p>At a wealth management forum on Saturday, he commented on the replacement of ICOs with the new concept of STOs, <a href=\"http:\/\/economy.caijing.com.cn\/20181201\/4542316.shtml\" target=\"_blank\" rel=\"noopener\">saying<\/a> they were still out of bounds.<\/p>\n<p>He said (according to a rough translation):<\/p>\n<blockquote readability=\"6\">\n<p>\u201cI will make a risk warning to those who are\u2026in Beijing and want to issue STO. Don\u2019t do it in Beijing.\u201d<\/p>\n<\/blockquote>\n<p>STOs <a href=\"https:\/\/www.ccn.com\/exclusive-spacex-alums-crypto-exchange-will-sell-stock-through-security-token-offering\/\">tokenize assets<\/a> and allow investors to purchase a share in the profits gained from those assets, something which ICOs had to carefully sidestep around by insisting that tokens did not represent a share in profits but were \u201cutility tokens,\u201d etc. For many international investors, security token offerings offer the best of both worlds by combining the liquidity of the <a href=\"http:\/\/ccn.com\/ico-news\">ICO method<\/a> with the regulatory compliance of more traditional investment vehicles, but for now, it seems that STOs will be viewed in the same light as ICOs, as far as Beijing is concerned.<\/p>\n<h2>China\u2019s Stance on Token Fundraising<\/h2>\n<p>The People\u2019s Bank of China previously <a href=\"https:\/\/www.ccn.com\/china-ico-ban-sees-startups-japan-bound-token-listings\/\">banned ICOs<\/a> outright in September 2017 and shut down many cryptocurrency exchanges in the process. The PBoC stated last month that there would be a crackdown on crypto airdrops as well (free cryptocurrency token giveaways).<\/p>\n<p>A PBoC vice president named Pan Gongsheng said earlier this year that the bank had plans to take down ICOs based abroad that continued to solicit Chinese investment, stating:<\/p>\n<blockquote readability=\"7\">\n<p>\u201cAny new financial product or phenomenon that is not authorized under the existing legal framework, we will crush them as soon as they dare to surface.\u201d<\/p>\n<\/blockquote>\n<p>In August, a Chinese district also <a href=\"https:\/\/www.ccn.com\/china-crackdown-after-beijing-guangzhou-hub-bans-cryptocurrency-events\/\">forbade<\/a> local businesses to participate in hosting events or having any kind of promotions involving cryptocurrency.<\/p>\n<p>While Chinese authorities are retaining their hard stance on crypto-fundraising, other governments are more open to STO fundraising, leading to many blockchain forms to abandon the somewhat disgraced ICO method for its legally compliant relative.
